The account, commercial and acceptable-use terms governing CareMaSym.
Agreement and eligibility
These Terms apply to the website, platform, mobile applications and related services. A customer accepts them through an Order Form, organisation account or service use. The person accepting for an organisation confirms authority to bind it. An Order Form prevails where it expressly conflicts.
The service
CareMaSym provides care-management, scheduling, recording, reporting and communication functionality. Features may evolve. CareMaSym supports professional judgement but does not replace clinical, safeguarding, emergency or business-continuity procedures.
Customer responsibilities
- Configure roles, branches and permissions using least privilege.
- Ensure instructions and data are lawful, accurate and appropriate.
- Maintain staff training, devices, connectivity and contingency plans.
- Provide required privacy information and lawful bases.
- Promptly report compromise, errors and unauthorised access.
Acceptable use
Users must not share credentials, bypass controls, disrupt or probe the service, upload malicious or unlawful content, scrape without permission, misrepresent care records, or use CareMaSym to harm, discriminate or surveil unlawfully.
Accounts, suspension and security
Customers control authorised users and must promptly remove access when duties or employment change. We may suspend access where reasonably necessary to protect people, data, law or service integrity and will work to restore it when the risk is resolved.
Fees, term and termination
Fees, billing, renewal and term are in the Order Form. Termination rights include material unremedied breach and circumstances allowed by law. At contract end, access ceases and data return or deletion follows the Agreement and DPA.
Intellectual property and data
CareMaSym and its licensors retain service and software rights. Customers retain rights in their data and grant only the rights needed to provide the service. Feedback may be used for improvement without identifying its contributor.
Warranties, liability and law
We provide the service with reasonable skill and care, but no online service is error-free. Contractual caps and exclusions apply only as permitted by law. Nothing excludes liability that cannot be excluded, including fraud or death or personal injury caused by negligence. Governing law and courts are set out in the Order Form.
Changes and contact
We may update these Terms for legal, security or service changes and will give reasonable notice of material changes. Contact hello@caremasym.com with questions.
